On November 3, 2026, Missourians will vote on a new Amendment 3. If you voted in 2024, you’ve seen that name before: that Amendment 3 put reproductive freedom in the state constitution with 51.7% of the vote. This one would take it back out.
What the 2026 Amendment 3 would do
The legislature referred the measure to the ballot. It would repeal most of the 2024 amendment and ban abortion except to protect the life of the mother, or in cases of rape and incest up to 12 weeks. It would also write a ban on gender-affirming medical care for minors into the constitution.
The fight over the ballot language
The ACLU of Missouri sued over the ballot summary in July 2025. In December 2025 an appeals court rewrote part of it, so the ballot now states that a “yes” vote would take away “reproductive healthcare rights, including abortion through fetal viability.”
Where the race stands
A Saint Louis University/YouGov poll found 47% support, 40% opposition and 12% undecided: ahead, but short of a majority. The opposition campaign, Stop the Ban Missouri, launched in May 2026 with nearly $2 million raised, calling the measure a “bait and switch” on a decision voters made less than two years earlier.
Where Josh Hawley stands
Hawley opposed the 2024 amendment and is campaigning for this one. “I absolutely am going to be involved,” he told reporters in February. “I just think Amendment 3 is so vital to end abortion on demand in Missouri.” In September he took the fight national with a “Declaration for Life” calling for a federal ban on mifepristone. More on that.
